what were the cops doing last nite when they pulled me over for a dui?
Posted by adminSep 9
i had only 2 1/2 beers and one shot in a 3 hour time period. i left the bar thinking and really sure of my self that i could go home i even ate a hotdog and drank a glass of water before i left the bar. the i proceed home and get pulled over. i passed the sobriety test and blew in the machine. they said i passed. i was honest and told them i had a few drinks. well the decide to take me to there city station and test me on another machine. and they let me make a call to have a ride come get me. they were satisfied with the result from there machine so they took me to the state police barricks and i blew in that machine twice and finally failed the last time. i blew in the machines like 10 times threw out nite. then they took me back to there station and released me to my dad and i went home. they even never read me my rights i signed a paper and the let me leave. ive never been introuble with the law in my life im 25 years old why were they stalling everything and changing machines?
i understand drinking and driving is wrong, damn i dont even drink ever. it was rare for me to even be in a bar. im not asking to get out of it too. i just thought they were being shady the cop even said i dont even appear to be drunk, im 6ft2 150 pounds i think one beer will put me over the limit now. i know what i did was wrong. i dont think the cops needed to be physical for no reason. im 25 years old i have never had a speeding ticket nor been in an accident nor seen a wreck. ive been driving since i was 16. they even let me walk out of the building after they got the reading they wanted i signed a paper they said bye and i said bye it just didnt add up to me. it was almost 2 simple.
i live in western pennsylvania
the paper had something to do with consent for the breath test they wouldnt let me have a copy. i was too nervous and wanted to go home i know that was dumb but those guys were mean and i was scared i did anything they wanted so i could leave.

All machines can and are rigged (adjustment knobs in back). They pull this all the time. They just had to find the right machine with the right adjustments.
Everyone know that as the minutes tick by, your alcohol level DECLINES; not increases. You lawyer will get you out of this one, but it’s gonna cost you money, that will be passed on to the cops.

This is a goofy one for sure. It seems to me like they not only wasted your time but tax payers time as well. In the future don’t ever say that you had anything to drink just don’t answer that question that is an incriminating question and it gives them cause to further investigate you for DUI.

because your an Idiot.
Do you know you can kill someone.
Sorry, but they were just doing their job.
I know it seems harmless
but who says on another day you wouldn’t drink more. probably a lot more.
and that will be the day you get behind the wheel without thinking and hit a oncoming car with a woman and her baby killing them..
so now what do you say..
Manslaughter..or even death ..
sorry, if it seems harsh but it’s real life..no game to drink and drive

They only mirandize you when you are under arrest I am pretty sure. They had no reason to place you under arrest until you failed a sobriety test- which you didn’t at first.
You do, however, have to cooperate with said tests and when you sign for your DL, you agree to cooperate with field sobriety tests. You were wise to cooperate even though you weren’t under arrest.

The question is WHAT paper did you sign? A ticket? Need more information.

Adjustment knobs in the back?
Mirandize after an arrest?
Oh boy, stop giving such bogus info.
You didn’t blow 10 times. Miranda only applies if they interrogate you…they didn’t. What were your 10 results? Whatever.

It’s a crock.
They didnt print you or process you. Then you have nothing to worry about.
Wanna see the worst drunk drivers in your city? Go to the local cop bar and watch them stagger to their cars and head home.

Waaaaaaaa…….Waaaaaaaaaaaaaaa…
Let’s see… you had ‘only’ 2 1/2 beers and 1 shot in three hours…. you were ‘sure’ of yourself when you left… you get stopped by the police for some ‘unknown’ reason… you admit what you did was wrong….
And that police were the bad guys because of???????
150 lbs with at least three drinks in three hours would make you legally intoxicated in ANY state…
I’ve stopped hundreds of DWI offenders over the years and a large portion of them said they ‘only had a couple’ of drinks…
Just like your story…
Good luck in the future….

I could go into a long rant but I’m to busy banging my head on the desk.
You went through all of this and didn’t bother asking them what was going on. I have an extremely hard time believing that they were like, “Oh, you passed our tests but we’re bored and going to take you in anyway.”
When I got someone on the side of the road that is okay to drive I cut them lose and go look for someone that isn’t.
You never even said what you blew.
Miranda is not required on all arrests.

Quite often the person taking a breath test purposely blows incorrectly to make the test not work. Thats a perfect reason to do the test more than once.
A pbt on the street means nothing. It is not acceptable in court anyway. It is just used to confirm an officers suspicions.
You could have passed the intoxilizer test and still have been arrested for DUI. Depending on your driving conduct, which probably got you pulled over in the first place, the officers had planty of probably cause to arrest you.
Officers DO NOT HAVE TO READ THE MIRANDA WARNING. That is for in-custody INTERROGATIONS only.
You screwed up, suck it up and move on. It happens every day to normal people with no records. That should help you in court.
