What must I do to keep from losing my daughter to her father?

My 2 year old daughter is slowly being taken away from me and her brother because her father thinks it’s best for her to go to school where he lives 2 hours away and he has a lawyer who can make that happen. My daughter is not better off with her father or his side of the family. They are alcoholics and drug addicts that come out smelling clean as a rose just because they are great actors. How can I keep him from ruining our daughter’s life? He is a very selfish spitefull man who only thinks of himself and not what’s best for his little girl. The life I have made for my children is the best anyone could wish for. I have worked very hard to pull us out of the ghetto when their father left us, and was able to buy a beautiful house out in the country. Everything is clean and fresh, and the people are kind and giving here. He still lives in the ghetto and thinks it’s great. He drags her around from party to party and totally exhausts her. He’s not good for her. How do I get my kid back?

You need to file a Sole Custody Petition with the Court. You can petition the Court to grant you supervised visitation for the father.

if the father is indeed a drug addict and an alcoholic then it should be easy to prove that the child will be better taken care of at your house. unfortunately the courts will look at if you have a job and how much it pays. if you are on welfare and he isnt then he is likely to get the children because he can support them. If you can prove that he is an alcoholic and a drug user with photo evidence the courts should give you custody of the children.

1: get an attorney if you can afford one, if you cannot look for some pro bonos attorneys in your area, if you cannot find anybody to help you, look for this on the web, it’s the only free legal site I know of, but I am sure that if you live in a different area it can refer you to others. it is siulawschool, self/help, I do not remember the exact e-mail address, but I am sure you can find it if you look, good luck

go find a good layer, you need to have proof that he is unfit, and proof that she would be better with you. If he really does live in the getto, go take a picture of his house, and find out if there is any criminal activity near by. Try to justify the drug use from his family that your daughter would be around.
This isn’t always so, but on the bright side of things children are usually left with there mother unless proven unfit.

first you may want to think about having him followed by a detective when he has your daughter. this will show the court the lifestyle he lives(excessive partying and taking her with him). start recording all phone conversations. then petition the court for custody(full) and plead your case. example, she is better off with you because she is out of a dangerous environment, your lifestyle is better economically, and mentally. and she should not be torn or seperated from her family ex, you and her brother. enough video surveillance or pictures depicting or showing his negative lifestyle will help the court determine custody. good luck, also if he is on drugs and disputes that the judge can simply order a drug test screening(on the spot) and recess until the results come in(that day) and just because you may be on welfare doesn’t mean he’ll get the kids.

I am a father in South Carolina who kept my kids through a long custody battle.
They are all grown up now but I can’t help wondering if we are only hearing one side of the story.

Personally, there needs to probable cause that she’s being neglected. Other than that, you can tell them that he drags your two year old around from party to party, without any concern for her well being. You’ll need factual evidence that her father and his side of the family are alcoholics and drug addicts. Have they ever been charged with a violation of laws related to illegal substances and the such? Have any of them ever been charged with a DWI, or anything alcohol related misdemeanor? If so, you could get your lawyer to obtain criminal records of her father and his family or something like that. Other than that you need to prove that he is a spiteful, selfish man who thinks of himself and not what’s best for your daughter. You should be proud of how hard you worked to find you and your kids a better place to live! *applauds*
You could also file an appeal for whatever the judge’s final decision is not in your favor. Make sure, that before you proceed to file that appeal, that you collect any and all necessary evidence to back your claim up. Fight fire with fire. Your daughter deserves to live with you and if I were the judge in this case, I would definitely rule in YOUR favor.
